Solution Contract Management mission is to:
The Contract Manager's mission as part of the project team is to:
* Provide, during Tender and/or Execution phases, contract support dealing with administrative, contractual, financial and tax matters.
* Monitor and support the project execution, participate in project reviews, support on identifying and pursuing variation orders and claims.
* Ensure compliance with Group policies and liaise with corporate functions as and when required and develop a culture of best practices with IMPACT.
Key responsibilities / activities
* With Tender and Execution teams, negotiate main contractual documents with the support and assessment of all required SMEs monitor contractual commitments (Coming into Force, notifications, payment milestones, claims, and Variation orders...) in line with group rules and guidelines.
* Review and highlight the key contractual, financial risks and administrative obligations of the project considering the customer context in order to enforce Schneider Electric contractual rights.
At the tender phase:
* Perform a contract review (including terms and conditions) in accordance with the rules of engagement and in consultation with Legal;
* Advise about the actual implementation of the suspension notices during execution, and recommendations to optimize SE’s capacities to claim compensations in case of suspension or termination.
* Review final contract against agreed and approved position following internal policies;
* Propose commercial strategy for winning contractual set-up and work with other key stakeholders to perform the contract review and negotiation.
* Identify, review and mitigate financial, and tax related risks in consultation with the relevant subject matter experts.
* Support the finalization of contracts with customers and/or subcontractors in consultation with the relevant subject matter experts.
* Ensure back to back terms with key suppliers are implemented as appropriate.
* Perform a contract handover to the execution team, ensuring their understanding of key contractual aspects.
At the execution phase:
* Administer the project execution against contractual rights and obligations;
* Ensure that contractual obligations are performed, properly documented and closely followed up;
* Advise about the actual implementation of the suspension notices during execution, and recommendations to optimize SE’s capacities to claim compensations in case of suspension or termination.
* Support project manager on risk and opportunity identification and management;
* Identify, prepare, submit, and negotiate variation orders and claims with both customer and subcontractors in a timely and effective manner;
* Draft contractual correspondence in consultation with Legal as required;
* Participate in project reviews, propose and support mitigation actions as required;
* Ensure local tax, bonding, insurance & customs issues are identified and addressed.
If required, support Contract/ Project Administration team in:
* support on filing the contract related documents pre-sales and during execution;
* preparing and negotiating applications for payment and invoicing;
* implementing and following up on financial means of payment such as letter of credits, bank guarantees and credit insurance;
* handling tax related matters as per guidelines (for example VAT registrations);
* assisting the project manager in the cost and value reconciliation of the project with particular focus on variation/ claim forecasting.
* Support the deployment of Corporate guidelines, CPP change order & claim management, and best practices.
Requirements:
Education: University and/or business school and/or engineer diploma: Master's degree or equivalent BAC+5, Engineering, business administration, international trade and/or Law Diploma, Contract Management Certification or equivalent.
Language requirements: English speaking. Fluent Spanish.
Experience: >5 years’ experience in contract management in a project environment or project/finance management.
Skills requirements:
Strong analytical skills, stress resistant, excellent verbal and written communication skills, ability to influence stakeholders across the project, resourcefulness.
